Drawing on comparative policy analysis, epidemiological evidence, and legal scholarship, we argue that while the proposal reflects legitimate concerns about addiction, mental‑health outcomes, and the extraction of Indian data for foreign AI development, a total prohibition is likely to be counter‑productive. A calibrated regulatory framework that combines age‑verification, content‑moderation, data‑localisation, and digital‑literacy interventions offers a more balanced pathway for safeguarding Indian youth while preserving constitutional freedoms and fostering a vibrant digital economy.

By contrast, a multifaceted regulatory architecture that couples robust age‑verification, data‑fiduciary obligations, digital‑literacy, and targeted mental‑health support can more effectively mitigate harms while preserving the dynamism of India’s digital economy.

The Indian experience will contribute valuable empirical evidence to the worldwide discourse on youth‑centric digital governance and may serve as a template for other emerging economies wrestling with the twin challenges of protecting children and harnessing data for inclusive AI development.
